利用規約

第1条(目的および適用範囲)

  1. 本規約は、株式会社鼓地蔵(以下「当社」という)が運営するフラレッスン動画のサブスクリプションサービス(以下「本サービス」という)に関する規約です。本規約は、当社が提供するフラレッスン動画(以下「コンテンツ」という)を、サブスクリプション形式で提供し、皆様にご利用いただくことを目的としたものです。

  2. 本サービスの利用申込を行った皆様(以下「利用者」という)は、当該申込の時点で本規約に同意し、本規約を当社と利用者との契約内容とすることに合意するものとします。

  3. 利用者は、本サービスの利用およびコンテンツの視聴において、本規約に定める事項が適用されることを承諾し、これらを遵守するものとします。

第2条(サービス提供方法)
本サービスの提供は、毎月定められたスケジュールに従い、当社が配信するフラレッスン動画を利用者が視聴できる形で行います。サブスクリプションに基づき、動画は継続的に提供されます。

第3条(利用申込および契約成立)

  1. サービスの利用申込は、当社所定の手続きに従い行うものとします。

  2. 本サービスの利用契約は、利用申込手続の上、支払いが完了した時点で成立するものとします。

  3. 利用者は、本サービスをフラレッスンを受講する目的のみに利用し、当該目的以外の利用を行わないものとします。

第4条(利用料金の支払)

  1. 利用者は、本サービスの利用に関して当社が別途定める利用料金を支払うものとします。

  2. 利用料金の支払方法および支払期限は、当社が定めた方法に従うものとします。

  3. 利用料金が支払期限までに支払われない場合、当社は利用者の利用契約を解除することができ、また、当該利用者の今後のサービス利用をお断りする場合があります。

第5条(コンテンツの視聴方法)

  1. 本サービスにおけるコンテンツは、オンラインでの視聴を前提とし、物理的な媒体による提供は行いません。

  2. 利用者は、当社が指定するオンラインプラットフォームを通じてコンテンツを視聴するものとします。

  3. 1つの申込に基づく視聴権は1人の利用者に限られ、申込者以外の第三者と共有すること、または複数人で視聴することは禁止されています。これに違反した場合、当社は利用者の利用契約を解除し、以後のサービス利用をお断りすることができます。

  4. 支払い完了後、合理的な期間内に視聴が可能となるため、問題が発生した場合は当社に問い合わせてください。

第6条(キャンセルおよび返金)

  1. 本サービスはサブスクリプション形式のため、利用者が支払い後にキャンセルを希望しても返金には応じません。

  2. サービスの性質上、提供されたコンテンツの一部もしくは全てが視聴できなかった場合であっても、返金や補償は行いません。

第7条(サービスの中断・変更・終了)

  1. 当社は、以下の場合において本サービスの提供を中断、変更、または終了することがあります。
    (1) システムのメンテナンスやアップデート
    (2) 天変地異や不可抗力による中断
    (3) 法的な理由やその他当社の合理的な判断による場合

  2. 上記の事由によるサービス提供の中断等に関して、当社は利用者に対して一切の責任を負いません。

第8条(禁止事項)
利用者は、以下の行為を行ってはならないものとします。
(1) コンテンツの複製、配布、公開、または第三者への譲渡
(2) コンテンツの不正使用や改変
(3) 他の利用者や第三者に対する迷惑行為
(4) 法令や公序良俗に反する行為

第9条(個人情報の取り扱い)
当社は、利用者から提供された個人情報を適切に管理し、法令に従って取り扱うものとします。詳細は、当社のプライバシーポリシーに基づきます。

第10条(免責事項)

  1. 当社は、サービスの提供において、利用者がサービスを利用する際に発生した損害について、当社の故意または重大な過失がない限り、一切の責任を負いません。

  2. 本サービスの利用により発生したいかなるトラブルについても、当社は一切の責任を負いません。

第11条(規約の変更)
当社は、本規約を随時変更することができ、変更後の規約は当社が指定する方法で告知し、告知後の利用者によるサービス利用をもって、変更に同意したものとみなします。

第12条(管轄裁判所)
本規約に関する紛争は、当社の所在地を管轄する裁判所を第一審の専属的管轄裁判所とします。

Terms of Service

Article 1 (Purpose and Scope of Application)

  1. These terms and conditions (hereinafter referred to as "Terms") apply to the subscription service for online hula lesson videos (hereinafter referred to as "the Service") operated by Kojizo Inc. (hereinafter referred to as "the Company"). The purpose of these Terms is to provide users with access to hula lesson videos (hereinafter referred to as "Content") through a subscription model.

  2. By applying to use the Service, all users (hereinafter referred to as "Users") agree to these Terms and consent to their content as part of the contract between the Company and the Users.

  3. Users agree that these Terms apply to all aspects of using the Service and viewing the Content, and they pledge to comply with them.

Article 2 (Service Provision Method)
The Service will provide hula lesson videos on a monthly schedule specified by the Company. The videos will be available for viewing by the Users as part of the subscription-based service.

Article 3 (Application for Use and Contract Formation)

  1. Applications for use of the Service shall be made according to the procedures specified by the Company.

  2. The contract for using the Service shall be deemed established once the User completes the application and payment process.

  3. Users may only use the Service for the purpose of viewing the hula lessons and may not use the Service for any other purposes.

Article 4 (Payment of Service Fees)

  1. Users are required to pay the fees specified by the Company for the use of the Service.

  2. The method and deadline for payment of fees will be determined by the Company.

  3. If Users fail to pay the fees by the specified deadline, the Company reserves the right to terminate the User’s contract and may refuse future use of the Service by the User.

Article 5 (Content Viewing Method)

  1. The Content provided by the Service will be made available online, and no physical media will be distributed.

  2. Users shall access and view the Content through the online platform designated by the Company.

  3. Only one person may view the Content per subscription. It is prohibited to share the subscription or allow multiple people to view the Content under a single subscription. Violation of this rule may result in the termination of the contract, and the Company may refuse future use of the Service by the User.

  4. If any issues arise after payment is completed, Users should contact the Company.

Article 6 (Cancellation and Refunds)

  1. As the Service is subscription-based, no refunds will be provided if the User wishes to cancel after payment.

  2. Even if the User is unable to view part or all of the Content due to technical issues, no refunds or compensation will be provided.

Article 7 (Suspension, Changes, and Termination of Service)

  1. The Company may suspend, change, or terminate the Service under the following circumstances:
    (1) Regular or emergency maintenance or updates of the system
    (2) Natural disasters or other unavoidable circumstances
    (3) Legal reasons or other circumstances deemed necessary by the Company

  2. The Company shall not be liable for any damages incurred by Users due to the suspension, changes, or termination of the Service for the reasons stated above.

Article 8 (Prohibited Actions)
Users are prohibited from the following actions:
(1) Copying, distributing, publicly displaying, or transferring the Content to third parties
(2) Unlawful use or alteration of the Content
(3) Causing trouble or inconvenience to other Users or third parties
(4) Engaging in actions that violate laws or public order and morals

Article 9 (Handling of Personal Information)
The Company will handle the personal information provided by Users in accordance with the laws and the Company's privacy policy.

Article 10 (Disclaimer)

  1. The Company shall not be held liable for any damages caused to Users during the use of the Service unless caused by the Company's willful misconduct or gross negligence.

  2. The Company shall not be responsible for any disputes or troubles that arise during the use of the Service.

Article 11 (Changes to the Terms)
The Company reserves the right to modify these Terms at any time. The modified Terms will be announced through the method designated by the Company, and continued use of the Service by the User will constitute agreement to the new Terms.

Article 12 (Governing Court)
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts governing the location of the Company’s headquarters.
